The following communication was received on July 6th from the Law Office of William J. Cluck, counsel to TRRAAC:
“On Tuesday March 10, 2009, Ned Wehler, project director for ARM Group, [Inc.], sent an e-mail to Manheim Township manager, Mike Rimer (with copies to Keith Orris and Jan Bergen), inviting the township to attend a pre-construction job conference at the former dump on Monday March 16 at 1 pm. Wehler attached to the e-mail a tentative agenda. The invitees included Bob Desmarais as a representative of the neighborhood. A representative from TRRAAC and East Hempfield Township or Lancaster Township was not invited.
“Mr Rimer did not forward the e-mail to the Manheim Township Board of Commissioners until Monday March 16 at 11:50 am (one hour prior to the conference). Mr Rimer specifically notes in his message to the Commissioners the ‘breadth of participants being invited to this program, which includes DEP and neighborhood association representatives.’
“Later that afternoon, Rick Kane, Manheim Township Fire Chief, who attended the conference on behalf of the Township, reported by e-mail to Rimer, and noted the list of attendees, which did not include any neighborhood representatives.
“Mr Rimer then informs the Commissioners the meeting was ‘informative and a success.’
“The project partners excluded local government and neighborhood groups who have raised concerns about the project. The sole neighborhood representative invited did not attend or send a designee, according to the e-mails obtained from Manheim Township.”
