Brunswick Annex owners granted 120 day extension for planning remediation

Hamid Zahedi, a partner in the entity that owns the Brunswick Hotel and the Brunswick Annex and counsel Paula Leight, of Mette, Evans & Woodside, appeared before the Building Code Board of Appeals  and were granted 120 days to explore three alternatives and submit a proposal to the Lancaster City Office of Code Compliance and Inspections.

The city will then review the proposal and, if accepted, arrange a time table for implementation with the owners.  The issue will only return to the Board if the owner later appeals the determinations of the city code officials.

The Annex remains condemned and is not to be used without obtaining City authorization for entry.

Leight said the owners would explore three options:  Demolition, a remediation program, and gutting the interior of the building including remediating for the purpose of a different use.

A representative of the city testified that on July 12, 2012 several building officials and health officials went to hotel and were admitted to the Annex.  They found extensive roof and plumbing leaks and mold.

The city representative also noted that the Annex is listed as a separate parcel from the Hotel and the matter under review does not affect the hotel per se.

In response to a board member request that the Board be advised what planning progress taking place, Leight offered to submit a written progress report in 60 days.

At the outset of the meeting, Michael Springer was elected as Chair and Darlene Taylor as Co-Chair.
