Chief Justice defends Supreme Court’s recusal policy

…[Chief Justice John] Roberts said justices’ decisions on recusal are not subject to any review because they sit on the nation’s court of last resort.

He added that when justices assess any potential conflict of interest, they must consider that no other judges can substitute for one of the nine.

“If a justice withdraws from as case,” he observed, “the court must sit without its full membership. A justice accordingly cannot withdraw from a case as a matter of convenience or simply to avoid controversy. Rather, each justice has an obligation to the court to be sure of the need to recuse before deciding to withdraw from a case.”
